Mabry's Est

...The Estate of her said husband Ephraim Mabry...to the Substance of his Will Sworn to and provided by two Evidences to the original Will which was lost during the late Troubles Daniel Mabry apppeared in open C. & being duly Sworn, made Oath That he, agreeable to an Order made at Last Court, had left true Copy of such Citation with each of the Legates named in such will, Whereupon the Court ordered that Letters of Administration be granted to said Mabry with a Copy of such will annexed which are as follows.

Fairfield County

To all to whom these presents shall come Greeting

Know Ye that sometime in the Month of September or October 1778, Ephraim Mabry of the said District made his Last Will and Testament & Signed Sealed & delivered the same as such in the presence of Phillip Combs and Elizabeth Duke the said will was read in thir presence and They Signed their names at Witness thereto which will was Lost during the late Trouble but the Substance thereof having been set down in Writing and proved by the said Phillip Combs & Elizabeth Duke and due Notice thereof having Been Served on each of the Legatees and nearest of Kin and no caveat being entered or any objection being made to the same by the parties concerned, We do approve and allow of the same and Grant Letters of Administration, with a Copy of such papers writing thereto annexed of all and Singular the Goods and Chattels Rights and Credits of the said deceased unto Mary Mabry sole Executrix named in such will who being dully Sworn in open Court well and faithfully to administer and make a full & perfect Inventory of all and Singular the Goods and Chattels Rights and Credits and to exhibit the same Inventory with an Account how the same has been disposed of unto the office of the Clerk of our Court in orderj to be recorded on or before the second Monday in November next and to render a true and just Account Calculation & reckoning thereof when thereunto required

Substance of Ephraim Mabry's Will

I Ephraimn Mabry, in the name of God Amen, being weak of Body but sound in Memory do make this my last Will and Testament, after commending my Soul to God that gave it, and my body to the Earth to be buried in a Decent manner do Give and bequeath my Estate as follows Viz: I do Give and bequeath to my Son Joel Mabry Ten pounds I Give and bequeath to James Thomas Ten pounds, I give and bequeath to Daniel Mabry, Cicely Mabry, Margaret Thorchey Mabry, Adam Poole Mabry, Mary Mabry, Elizabeth Mabry, and Ephraim Mabry one Cow and Calf each at their coming to age or marriage and I do appoint my wife Mary Mabry my only -- Executrix and do Give unto her hand my Whole Estate consisting of Lands, Negroes, Stock and Hosehold Furniture and all that is my property to dispose of to my above named Children as she may see Cause.

Personally appeared before me, Sampson Harris one of the Justices assigned to keep the peace for said County, Phillips Combs and Elizabeth Duke and after being duly sworn, deposeth and Saith that sometime in the month of September or October in the year 1778 that they was at the House of Epphraim Mabry in the State of South Carolina and district of Camden and that he did then and there Sign a Will as his last Will and Testament and affixed his Seal with same the Content as above as near as They can recollect and further Say that Mary saw Charles Goodrich witness the same as Subscribing evidence.
