"State of South Carolina
This Indenture made the 14th day
of No. Anna Domini one thousand seven hundred and nine two between John
Roper of North Carolina Richmon County and Crenshaw Duke of Lancaster County
South Carolina Witnesseth that for and in Consideration of the Sum thirty
five pounds ???? then in hand paid by the sd Crenshaw Duke at and before
the Sealing and Delivering of these presents the receipt whereof is hereby
knowledged the sd John Roper have granted bargained sold delivered released
and confirmed and by these Presents do grant bargained and sell unto sd
Crenshaw Duke a certain Tract or parcel of Land containing 250 Acres Situate
Lying and being on the South Side of the Catawba River being Made over
as a Deed of gift from his brother John Rogers the above bargained premises
as above Specified the causes and Disasters as follows sd 10E59 to hickory
So.43W57 to a White Oak N47W50 to a Black Oak No.35E34 to a hickory containing
250 Acres of Land together with all and Singular the houses Edifices Buildings
Orchards Woods Timber and Timber Trees Meadows Pastures Water & water
Liberties priviledges property Rights & all Appurtenances whatsoever
belonging or in any wise appertaining & they Reversion & Reversions
Remainders & Remainders Rents & Profits thereof and every part
& parcel thereof or any Claim and Demand whatsoever of the said James
Rogers of unto or out of the premises and Appurtenances thereunto belonging
and every part and parcel thereof To have and to hold the Plantation or
Tract of Land above Mentioned with every of the appurtenances thereunto
belonging herein before granted released and conveyed unto the sd John
Roper & unto the sd Cre'w Duke by the sd John Roper to the only proper
use & behoof of him sd Crenshaw Duke his Heirs & Assigns and the
sd John Roper doth hereby for themselves and their heirs and Ex & Adm
& Assigns Promise Covenant and Agree to and with the Sd Cre'w Duke
his Heirs and Assigns in Manner and form following Vis That the sd John
Roper now he is and until the Exe'n of these presents shall stand served
of a sure and defensible Right of Inheritance in fee Simple of and in all
the aforesaid Tract or parcel of Land with all the Members & Appurtenances
without any Manner of Condition Trust Mortgage judgment or Incumbrance
whatsoever to alter or change the Same & Also that the sd Crenshaw
Duke his Heirs & Assigns shall and May at all Times hereafter peaceably
and quietly have hold use occupy and enjoy the sd Tract of Land with every
Of the Appurtenances thereunto belonging without any Manner of hindrance
Molestation of the sd John Roper his Heirs and assigns and all and every
person whomsoever and Lastly the said John Roper and for themselves and
their Heirs Ex'r Adm'r & Assigns the sd plantation or Tract of 250
Acres of Land with all the Appurtenances unto the said Crenshaw Duke his
Heirs and Assigns will warrant & forever defend by these Presents.
In witness whereof the said John Roper have hereunto set their Hand and
Seal the day and year above written

of December 1797
