"State of South Carolina
This Indenture made
this Seventh day of December in the year
of our Lord one thousand Seven hundred and Eighty five
and in the Tenth year of American Independence Between
Thomas
and Mary Dukes of the County of Fairfield
planters of the one part, and Robert and
John Ellison of the County of Fairfield
in the said State planter of the other part Witnesseth
that the said Thomas and Mary Dukes for and in Consideration of the Sum
of Fifty pounds
to him in hand well and truely paid by the said Robert and John Ellison
at or before the writing and Delivery of these presents the Receipt whereof
is hereby acknowledged and thereof and of and from every part and parcel
thereof doth acquit Release and Discharge the said Robert and John Ellison
their Heirs and assigns by these presents he the said Thomas and Mary Dukes
Hath Granted Bargained Sold aliened Remised Released Conveyed
and Confirmed and by these presents Doth grant Bargain Sell
Alien remise Release Convey and Confirm unto unto the said Robert and John
Ellison in their actual possession now being by virtue of a Bargain and
sale to him thereof -- made by the said Thomas and Mary Dukes by Indenture
bearing date the Day next before the day of the date of these presents
for the Term of one year Commencing from the Daysend before the date of
the date of the said Indenture and by the force of the statute made for
Transfering Uses into possession of force in this state and to their Heirs
and Assigns for Ever All that Plantation or Tract of Land One
hundred acres more or Less Situate Lying
and being on the wateree Creek
being bounded by a branch called the Dry
Branch and running to the upper Line of the Tract hereafter Mentioned to
be granted to John Aldridge thence a Long the said Line to the Creek the
said Creek being the Line down to the other Line which said one hundred
and fifty Acres of Land originally granted to the said John Aldridge the
fifth day of September 1750 as by the said grant and plat reference being
thereunto had will more fully and at Large Appear
Together with all and singular the houses out houses Ways
Wells Waters WaterCourses woods Underwoods Timber and Timber Trees Profits
Commodities Appurtenances and Hereditaments whatsoever to or upon the aforesaid
Plantation or Tract of Land Standing being belonging in any wise incident
or Appurtaining or accepted or repeated taken or knowed held Occupied possessed
or enjoyed as part parcel or member of the same and the Reversion and reversions
Remainder and Remainders Rents Issues and profits thereof and of Every
part and parcel thereof and also all the Estate Right Tittle Interest Tittle
possession property profit Claim and Demand whatsoever Either in Law or
Equity of him the said Thomas and Mary Dukes of into or out of the aforesaid
premises and appurtenances To Have and to Hold the aforesaid
Plantation or Tract of Land being part or parcel of the said Three hundred
and fifty Acre Tract so granted as aforesaid and all and singular other
the premises herein before mentioned or mention Intended to be hereby granted
and Released with their and every of their Appurtenances unto the said
Robert and John Ellison their Heirs and assigns to the only and proper
use and behoof of them the said Robert and John Ellison their Heirs and
assigns for Ever and the said Thomas and Mary Dukes for himself his heirs
and assigns Doth Covenant grant and agree to and with the said Robert and
Ellison their Heirs and assigns for ever by this presents that it shall
and may be Lawful to and for the said Robert and John Ellison their heirs
and assigns to Enter into Hold occupy possess and Enjoy the said Plantation
or Tract of Land and all and Singular other the premises and appurtenances
herein before mentioned without any Lawsuit, Trouble Molestation Diver
or Interruption of the said Thomas and Mary Dukes or his heirs or any other
person or persons lawfully Claiming, or to Claim by from or under him them
or any of them or otherwise how soever and also that the
said Thomas and Mary Dukes and their heirs Shall and will from time to
time and at all times hereafter at the reasonable request and at the proper
Costs and Charges in the Law of the said Robert and John Ellison their
heirs and assigns make do Acknowledge and Execute or cause to be made Done
acknowledged and executed all such further and other Lawful and reasonable
Ack__ Conveyances and assurances in the Law whatsoever for the further
and better and more perfect Granting Conveying and assuring of all and
singular the aforementioned premises and appurtenances with Every part
and parcel thereof to the said Robert and and John Ellison their heirs
and assigns forever in manner and form aforesaid as by his or their Council
Learned in the Law shall be reasonably Devised and required and Lastly
that the said Thomas and Mary Dukes and their Heirs the said Plantation
or Tract of Land and All and singular other the premises and appurtenances
herein before mentioned or intended to be hereby granted and released and
every part and parcel thereof unto the said Robert and John Ellison his
heirs and Assigns in manner and form aforesaid against him the said Thomas
and Mary Dukes and their heirs and all and every other person or persons
whomsoever shall and will warrant and for ever defend by these presents
